These terms govern your use of the website and services operated by Fairfield Heavy Duty Towing at fairfieldheavydutytowing.com.
By accessing or using this website, submitting a contact or estimate request, or engaging Fairfield Heavy Duty Towing to perform services, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, do not use this website or our services. We reserve the right to update these terms at any time. Continued use of the website or services after any update constitutes acceptance of the revised terms.
Fairfield Heavy Duty Towing provides towing and roadside services, including but not limited to heavy-duty towing, accident recovery, wrecker service, flatbed towing, winch-out service, roadside assistance, vehicle storage, and related commercial and emergency towing services. Services are provided in Fairfield, CA and surrounding communities.
All services are subject to availability, vehicle type and condition, road and site conditions, and operational limitations at the time of the request. We reserve the right to decline any service request at our discretion.
All estimates provided - whether by phone, email, contact form, or in person - are good-faith assessments based on the information available at the time. Final pricing may differ from an initial estimate if the actual scope of work differs from what was described or anticipated, additional equipment is required, road or site conditions create unexpected complexity, or the vehicle condition differs materially from what was communicated.
We will notify you of any material change in scope before proceeding with additional work. No work will begin without your verbal or written authorization.
Estimates are not binding contracts. A binding agreement is formed only when both parties agree to a defined scope and price in writing or verbally confirm the work authorization on site.
Service scheduling is subject to crew and equipment availability. Quoted response times are estimates and may be affected by traffic, weather, road closures, prior calls, and other factors outside our control.
If you need to cancel a scheduled non-emergency service appointment, please notify us as early as possible by phone or email. Cancellations made after our crew has been dispatched may be subject to a trip charge to cover fuel, labor, and equipment costs incurred up to the point of cancellation.
Emergency calls in progress cannot be cancelled once the crew is on scene and has begun work.
Payment is due upon completion of service unless a prior billing arrangement has been established in writing, such as for fleet accounts. We accept payment by cash, check, and major credit cards. Specific accepted methods will be confirmed at the time of service.
Invoices for fleet and commercial accounts are due within 30 days of the invoice date unless otherwise agreed in writing. Late payments may be subject to a finance charge at the maximum rate permitted byCalifornia law.
Vehicles in storage are subject to daily storage fees beginning the day after the vehicle is brought to our storage facility. Storage fees continue to accrue until the vehicle is released. We may exercise a lien on stored vehicles as permitted by California law.
When requesting service, you are responsible for providing accurate information about the vehicle type, weight, condition, and location. Providing inaccurate information may result in dispatch of the wrong equipment, which may delay service and could affect pricing.
You are responsible for ensuring that you have authority to authorize service on any vehicle for which you request service. By requesting service, you represent that you are the owner of the vehicle or have authorization from the owner to request towing or recovery.
Fairfield Heavy Duty Towing will exercise reasonable professional care in performing all services. However, our liability for any claim arising out of or related to our services - including damage to your vehicle during towing or recovery - is limited to the lesser of the actual cost of repair or the current fair market value of the vehicle at the time of the incident.
We are not liable for pre-existing damage to a vehicle, damage caused by conditions at the scene outside our control, or losses resulting from your failure to provide accurate information about the vehicle or its contents.
In no event will Fairfield Heavy Duty Towing be liable for indirect, incidental, consequential, or punitive damages of any kind, including loss of business, lost profits, loss of cargo, or loss of use of a vehicle, even if we have been advised of the possibility of such damages.
Services are provided on an "as is" and "as available" basis.Fairfield Heavy Duty Towing makes no warranties, express or implied, beyond the reasonable professional standard of care applicable to the towing and recovery industry. We do not warrant that our services will be uninterrupted or free from delay due to factors outside our control, including weather, road conditions, and equipment availability.
